ARTICLE 1. DEFINITIONS :

The company ROUVEYRE Sophie—a micro-enterprise registered with the Bayonne Trade and Companies Register (RCS) under number 753 342 948, with its registered office at 181 Promenade de la Barre, 64600 Anglet (Tel: 06.72.35.03.63 – Email: contact@intendancebasque.fr)—operates under the trade name "Intendance Basque."

The company ROUVEYRE Sophie provides property management and concierge services for primary or secondary residences located on the Basque Coast (department 64) under the trade name "Intendance Basque."

These General Terms and Conditions of Sale ("GTCS") govern the contractual relationship between ROUVEYRE Sophie ("Intendance Basque") and any individual or legal entity acting for non-professional purposes ("the Client") that has subscribed to one of our services.

Any subscription to or engagement for one of our services implies acceptance of these GTCS, to the exclusion of any other document.

 

ARTICLE 2 : TERMS OF SERVICE :

The website www.intendancebasque.fr is a showcase site highlighting the property management and concierge services offered by Intendance Basque. Online sign-up is not available.

Intendance Basque offers property management and concierge services to owners of primary or secondary residences located on the Basque Coast (Pyrénées-Atlantiques department, 64).

However, Intendance Basque does not operate throughout the entire department and reserves the right to decline a contract if the location is too far from its headquarters in Anglet.

Intendance Basque offers various packages and options available via monthly subscription in exchange for services provided.

Details regarding services and rates for the various packages can be found on our website or in the appendix to your quote.

Any client wishing to contract with Intendance Basque will meet with Ms. Sophie Rouveyre and provide a tour of the property concerned. This meeting is free and carries no obligation.

Following this meeting, the client will receive a quote specifying the chosen package, any selected options, the rates for each service, a copy of these terms and conditions, and payment details.

The client is required to carefully verify the accuracy of the information listed on the quote before signing it.

The client subscribing to the service need not be the property's occupant; they may sign up for a property management contract ("the Client") on behalf of a relative ("the Occupant").

 

ARTICLE 3 : PAYMENT – DURATION – RATES and TERMINATION

3.1 Payment :

Payment for services must be made via monthly bank transfer by the 5th of each month.

Upon subscribing to a service plan, payment will be due on a pro-rata basis for the remaining days of the current month. The same applies upon termination of the contract.

Any alternative payment method or schedule must be approved in advance by Intendance Basque.

In the event of repeated late payments or non-payment, Intendance Basque reserves the right to terminate the contract without notice: see "3.4 Termination."

3.2 Duration :

All our plans and selected options commit the client to a minimum term of 3 months from the date of subscription (service start date – see 3.4.1 Cooling-off period).

After this period, the contract may be terminated at any time subject to one month's notice: see 3.4 Termination.

3.3 Rates :

Intendance Basque reserves the right to revise the rates, service packages, services provided, and/or terms applicable to the client on an annual basis, on the contract anniversary date.

Rates for subscribed services are those in effect at the time of subscription, quoted in euros excluding tax (HT)*.

*Intendance Basque is not subject to VAT.

Rates quoted are valid for 3 months from the date of dispatch.

Once the quote is signed—thereby constituting a contract—the rate is guaranteed for 12 months from the date of signature (based on the date indicated on the quote).

Any changes made prior to the contract anniversary date cannot be applied to existing contracts.

Intendance Basque must notify the client of any such changes at least 3 months before the contract anniversary date.

  • by mail for any modification to these General Terms and Conditions of Sale, or any changes to rates, packages, and/or services that would be in the client's interest (price reductions, additional services, etc.)
  • by registered letter with acknowledgment of receipt, any modification having a significant impact on the client's contract, namely: price increases, a reduction in the services included in the plan...

 

If the client refuses the new terms, they must notify Intendance Basque in writing (preferably by email to contact@intendancebasque.fr) at least one month prior to the contract anniversary date in order to terminate the contract.

Failure by the client to respond will constitute acceptance; the new terms (rates, General Terms and Conditions of Sale, or services) will be deemed accepted by the client and will apply from the contract anniversary date.

3.4 Right of withdrawal and Termination:

3.4.1 Withdrawal period :

The Consumer Code provides for a 14-day cooling-off period starting from the signing of the quote.

Intendance Basque applies this cooling-off period provided that the contracted service has not been performed—even partially—before the 14-day period has expired.

To this end, Intendance Basque offers several options:

  • La The contracted service may only commence the day after the 14-day cooling-off period has elapsed. This period begins on the day the client signs the quote, which serves as the contract; the date indicated on the quote shall be deemed conclusive.
  • The contracted service begins the day after the signing of the quote, which serves as the contract.

In this case, the client agrees to waive the right of withdrawal. To do so, the client must complete the form provided for this purpose, which is attached to the quote.

However, should the client wish to withdraw within the 14-day period, they must pay the fees charged by Intendance Basque, calculated based on the work performed up to the time of withdrawal, up to a maximum of one month’s subscription fee according to the chosen plan.

To exercise the right of withdrawal:

The client must submit, in writing—preferably via email to contact@intendancebasque.fr—within 14 days of the date the quote was signed (with the date indicated on the signed quote serving as proof), their wish to terminate the contract, without notice and without providing a reason.

3.4.2 Termination by the client:

All plans and options are subscribed for a minimum period of 3 months starting from the service commencement date (see 3.4.1 Cooling-off period).

After the cooling-off period (see 3.4.1 Cooling-off period), the client may terminate the plan and any subscribed options at the end of the 3-month term, subject to one month's notice.

Once the initial 3-month period has elapsed, the plan and any subscribed options may be terminated at any time, subject to one month's notice.

In the event of force majeure (e.g., death of the occupant, fire rendering the property concerned uninhabitable, etc.) or at the discretion of Intendance Basque, the client may terminate the service without notice.

Notice must be given in writing, preferably via email to the following address: contact@intendancebasque.fr. The notice period begins on the date the email is sent.

3.4.3 Termination by Intendance Basque:

Intendance Basque reserves the right to terminate a subscription upon providing the client with three months' written notice.

Intendance Basque reserves the right to suspend its services in the event of late payment.

In cases of *force majeure*—such as cessation of business, death, or prolonged incapacity—Intendance Basque may terminate the contract without notice.

Notice must be given in writing, either via email (with an acknowledgment of receipt from the client) or by registered mail with acknowledgment of receipt. The notice period begins on the date the client’s acknowledgment email is received or on the date the client receives the registered letter.

In the event of repeated late payments or outstanding balances, Intendance Basque reserves the right to terminate the contract in accordance with the aforementioned provisions. The client remains liable for the three-month notice period and any outstanding amounts due at the time of termination.

 

ARTICLE 4 : PERSONAL SERVICES AND TAX CREDIT

Intendance Basque is a personal service provider that enables its clients to benefit from a tax credit.

To this end, Intendance Basque is registered with the relevant government authorities (registration number: see Legal Notices).

The tax credit for personal services is available to any tax household, provided they are tax residents of France (or Monaco) and are both the recipient and the payer of the services.

By choosing Intendance Basque for your home assistance services, you automatically qualify for a 50% tax credit. This means that half of your expenses are reimbursed by the State.

However, the State applies certain limits. We encourage you to check your eligibility at: Personal services: tax and social benefits and aid for individuals | Personal services (SAP).

Ms. Sophie Rouveyre / Intendance Basque cannot be held liable if a client fails to obtain the tax credit due to exceeding the applicable limits or for any other reason attributable solely to the client.

 

ARTICLE 5 : PACKAGES AND OPTIONS

Intendance Basque offers various plans and options available via monthly subscription or on an "on-demand" basis, with service levels varying according to the chosen plan.

You can find details regarding plans, services, and rates on our website or in the appendix to your quote.

5.1 General Information :

  • Monthly visit : Included in all plans

Intendance Basque commits to carrying out at least one visit per month to the property in question, Monday through Friday (excluding public holidays), during business hours.

This visit may take place either in the occupant's absence or presence, at the client's discretion. Visits will be scheduled according to Intendance Basque’s timetable and, whenever possible, coordinated with the occupant's schedule where applicable.

The purpose of the visit is to check the condition of the property, review any past or ongoing issues with the occupant, and assess the status of any work or interventions carried out by service providers.

 

  • Additional visit(s) : Billing upon request, based on the applicable formula.

Beyond the monthly visit—or any additional visit included in the selected plan, where applicable—Intendance Basque reserves the right to charge for extra visits (subject to the plan and current rates).

Where extra visits are included in the selected plan, these are limited to two per month in addition to the monthly visit.

Beyond these two extra monthly visits, Intendance Basque reserves the right to charge for additional visits at the rate specified in the contract.

Any visit requested by the client and/or the occupant outside of the monthly visit—including in the event of an emergency—shall be considered an extra visit.

 

  • Telephone support (daytime) : Included in all plans

Intendance Basque remains reachable by phone during business hours and commits to returning the client's call promptly if the initial call goes unanswered.

 

  • Telephone support (evenings and weekends) : Billing upon request, based on the applicable formula

Intendance Basque makes every effort to remain reachable outside of standard business hours, though this cannot be guaranteed. Depending on the service package, Intendance Basque reserves the right to charge a fee for telephone support provided outside of these hours.

Where the selected package includes telephone support outside of business hours, such calls must not be excessive, regular, or systematic.

Intendance Basque reserves the right to apply a surcharge should this occur.

"Evening and weekend" telephone support does not in any way oblige Intendance Basque to be available 24 hours a day, 7 days a week. Intendance Basque commits to returning the client's call as soon as possible, though this cannot be guaranteed.

 

  • Family report : Included in all plans

Intendance Basque keeps a record of all its interventions and actions regarding the properties entrusted to its care, as well as those involving clients and occupants.

Upon request and with the client's consent, a monthly report may be sent to the family, the client, and/or the occupant.

 

 5.2 Administrative :

  • Guidance and advice on active subscriptions and contracts : Included in all plans

Intendance Basque offers to review with you the maintenance contracts currently in place—or required—for your property, as well as their associated costs.

To do this, the client or occupant must provide the necessary information to Intendance Basque.

 

  • Administrative support : Option billed monthly, depending on the plan.

Intendance Basque offers assistance with the administrative management of your property, including bill payments, setting up or cancelling contracts, handling property-related administrative procedures, managing insurance, and more.

Intendance Basque acts in an advisory capacity and does not, under any circumstances, take the place of the client or the property's occupant.

Intendance Basque cannot be held liable for decisions made by the client or occupant, as the final decision rests with them.

This service is carried out during the monthly visit. Should the client or occupant wish for this service to be performed outside of the scheduled monthly visit, Intendance Basque reserves the right to charge for an additional visit.

 

  • Defending a request at a co-owners' general meeting : Billing upon request, based on the applicable formula.

Intendance Basque offers to accompany or represent you at the co-ownership general meeting for the property covered by the contract.

This service is available on an ad-hoc basis, specifically when a proposed project needs to be advocated for before the co-ownership association (e.g., installation of air conditioning, an awning, etc.).

 

 5.3 Minor repairs :

"Minor repairs" are defined as everyday breakdowns and malfunctions—for example, a lack of hot water, a broken roller shutter, a water leak, etc.

  • Business liaison, follow-ups regarding service visits, and post-service follow-up. : Included in all plans

In the event that a minor repair is identified by Intendance Basque or reported by the client or occupant, Intendance Basque will contact a service provider on the client’s behalf to carry out the necessary repairs.

Before the work is performed, a quote from the service provider will be submitted to the client for approval.

The service provider will be solely responsible for the work performed and any associated warranties. The client agrees to pay the service provider directly.

Intendance Basque will ensure the work is carried out promptly, follow up with the service provider if necessary, and verify that the work has been completed before the client makes payment.

In an emergency, if work is urgently required and the client is unable to approve a quote, Intendance Basque reserves the right to authorize emergency work up to a maximum cost of €500 (inclusive of tax).

If the nature of the repairs allows (i.e., no emergency) and the quote exceeds €800 (inclusive of tax), Intendance Basque commits to obtaining competitive bids by securing 2 to 3 quotes.

 

  • Carrying out minor repairs : Quote provided based on the selected package..

Intendance Basque is able to carry out minor handyman tasks. If Intendance Basque deems itself qualified to perform the work, it will provide a quote to the client prior to the intervention.

Where this option is included in the service package, the client must pay an additional charge for the supplies and materials required for the repairs—at no markup—as only the labor is included in the package.

 

 5.4 Routine maintenance :

"Routine maintenance" is defined as regular and necessary upkeep of the property—for example: boiler servicing, chimney sweeping, maintenance of green spaces and swimming pools, cleaning, etc.

  • Management of service providers, and provision of advice and interview follow-up during monthly visits. : Option billed monthly, depending on the plan.

Intendance Basque maintains regular contact with service providers, follows up as necessary, and verifies during monthly visits that the various maintenance tasks are carried out in accordance with the contract. Intendance Basque represents the client (or occupant) in the event of disputes, negotiations, etc.

 

 5.5 Building works :

"Building Works" are defined as major, exceptional projects carried out as part of the renovation of the dwelling covered by the contract—for example, facade refurbishment, bathroom renovation, etc.

  • Costing of the work : Quote provided based on the selected package.

Intendance Basque engages at least three contractors on the client's behalf to provide cost estimates for the desired work.

The client retains sole authority to approve the work and agrees to pay the selected contractors directly, in accordance with the approved quote.

 

  • Coordination of the work : Quote provided based on the selected package.

Intendance Basque coordinates the contractors and the work in accordance with the quote(s) approved by the client.

 

 5.6 Second home :

  • Closing up the property for the winter : Included in all plans

Intendance Basque handles the closing of the property after your departure: winterizing the pool, storing or covering garden furniture, managing heating during the winter, securing the premises, managing the alarm system (if applicable), etc.

This service is provided once a year at the end of the summer season.

If there is no dedicated pool service provider, Intendance Basque can handle pool winterization and maintenance throughout the winter, provided the client supplies the necessary chemicals.

 

  • Opening the accommodation for the season : Included in all plans

Intendance Basque handles the opening of the property prior to your first stay of the season: restarting the pool, checking the condition of outdoor areas, airing out the house, etc.

This service is provided once a year at the end of the winter season.

If there is no pool specialist, Intendance Basque can handle the pool reopening, provided the client supplies the necessary products and equipment. Intendance Basque does not manage the pool or provide maintenance during the summer season.

 

  • Management of stakeholders : Option billed monthly, depending on the plan.

Intendance Basque maintains regular contact with service providers (cleaning companies, gardeners, pool specialists, etc.), follows up as necessary, and verifies during monthly visits that the various maintenance tasks are carried out in accordance with the contract. Intendance Basque represents the client (or occupant) in the event of disputes, negotiations, and the like.

 

  • Preparing the accommodation : Billing upon request, based on the applicable formula.

Intendance Basque coordinates the various service providers to ensure your property is prepared before each of your stays throughout the year.

Upon your arrival, beds will be made, linens clean and ironed, and the property clean and welcoming, with the garden and pool well-maintained.

Upon your departure, Intendance Basque ensures the property is restored to order (handling dishes, linens, and waste).

Intendance Basque does not directly perform cleaning, ironing, or garden and pool maintenance; these services are carried out by external providers, the cost of which is borne by the client.

Intendance Basque provides this service exclusively for the client or their family. Intendance Basque does not provide this service in the context of seasonal rentals.

If this service is included in the chosen package, the number of "property preparations" is limited to a maximum of six per year, excluding winterization and opening services. Beyond this limit, Intendance Basque reserves the right to charge an additional fee.

 

  • Property viewings in the owner's absence : Included in all plans

Intendance Basque commits to carrying out at least one visit per month to the property in question, between Monday and Friday during business hours.

This visit will be scheduled in accordance with Intendance Basque’s timetable.

The purpose of the visit is to check the condition of the property, review any past or ongoing issues, and assess the status of any interventions or work performed by contractors.

 

 

ARTICLE 6 : RESPONSABILITY

Ms. Sophie Rouveyre / Intendance Basque acts in an advisory capacity to the client; she is not, and does not become, a party to any contract entered into between the client and a tradesperson, for example.

The client is the sole decision-maker; in accordance with the law, the client must enter into a contract or approve a quote with the tradesperson or external service provider.

The client agrees to pay the tradesperson or service provider directly.

Ms. Sophie Rouveyre / Intendance Basque does not act as an agent for any party.

Ms. Sophie Rouveyre / Intendance Basque cannot be held liable under any circumstances for the poor condition or lack of maintenance of a property, or for any malfunction, whether occurring before, during, or after the term of her contract.

Ms. Sophie Rouveyre / Intendance Basque cannot be held liable under any circumstances if the client or occupant chooses not to carry out necessary work, maintenance, or minor repairs.

In the event of a dispute with a tradesperson or contractor, the client or occupant must take action against that party. Ms. Sophie Rouveyre / Intendance Basque cannot be held liable, either directly or indirectly, for the relationship between the client and external service providers.

Regarding "Work Coordination" services, Ms. Sophie Rouveyre / Intendance Basque does not act as the project manager (*Maître d'œuvre*) but rather as a coordinator—handling scheduling, managing contractors, and issuing reminders, for instance; Ms. Sophie Rouveyre / Intendance Basque cannot be held liable for the poor execution of the work itself.

Civil liability insurance details are provided in the legal notices.

6.1. Governing law and jurisdiction

Any dispute or disagreement regarding the formation, validity, interpretation, or performance of the "Terms of Use" and/or "General Terms and Conditions of Sale" must first be settled amicably between the Parties. The User or client is encouraged to contact Intendance Basque—who will provide assistance in attempting to resolve the issue—at contact@intendancebasque.fr or via the website.

In the event of a dispute, the User or client may, if they wish, resort to conventional mediation—potentially through existing sectoral mediation bodies—or to any alternative dispute resolution method (such as conciliation). To contact the consumer mediator, the User may access the European Online Dispute Resolution (ODR) platform established by Regulation (EU) No 524/2013 of 21 May 2013.

If mediation fails or if the client does not wish to pursue it, they remain free to submit the dispute to the competent courts.

These terms are governed by and construed in accordance with French law. As a consumer, you may only bring legal proceedings relating to these terms before the competent court of your place of residence or the competent court of the place where ROUVEYRE Sophie / Intendance Basque is established in France. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the French courts.

6.2 Third-party services

The website www.intendancebasque.fr may contain links to third party websites, applications, services or resources (the “Third Party Services”) which are subject to different terms and privacy practices.Intendance Basque is not responsible for any aspect of these Third Party Services and links to such Third Party Services are not an endorsement.

 

ARTICLE 7: NON-DISCRIMINATION POLICY

Intendance Basque is committed to treating "clients" without distinction or difference in treatment based on discriminatory grounds.

Intendance Basque requires clients or occupants to refrain from making any distinction or difference in treatment based on discriminatory grounds—for example, when selecting a tradesperson or service provider.

The principle of non-discrimination stems from the principle of equality enshrined in the Constitution.

Accordingly, any distinction or difference in treatment is prohibited if it is based on any of the following grounds:

  • Physical appearance
  • Genetic characteristics
  • Disability
  • Gender identity
  • Morals
  • Name
  • Philosophical views
  • Political opinions
  • Sexual orientation
  • Origin
  • Claimed race, ethnicity, nationality: belonging or not belonging
  • Religion: belief or belonging or non-belonging
  • non-exhaustive list

 

ARTICLE  8 : MODIFICATION OF THESE TERMS

When we propose changes to these Terms, we publish the updated Terms on the website www.intendancebasque.fr and update the "last updated" date at the top of the page containing these Terms. The terms in effect at the time of your subscription will apply for the entire duration of that subscription. Any changes made during your subscription will apply only to new subscriptions.

Subscribing to a service constitutes your acceptance of the General Terms and Conditions of Sale.

Should any provision of the "General Terms of Use" (GTU) and/or "General Terms and Conditions of Sale" (GTCS) be deemed null, invalid, or unenforceable by law, regulation, or a final court decision, it shall be considered unwritten, and the remaining provisions of the Contract shall retain their full force and effect.

Failure by either Party to enforce, or a delay in enforcing, any provision of the GTU and/or GTCS shall not be construed as a waiver of the right to enforce that provision in the future.

For the purposes of implementing the GTU and GTCS, Intendance Basque elects domicile at the address specified in the "Legal Notice" section.

The GTU and GTCS are drafted in French. In the event that they are translated into other languages, the French version shall prevail. The GTU and GTCS are governed by French law.
